My Practice

 

I have a passion for resolving disputes through principled negotiation processes. My legal practice for the last 20 years has focused on providing mediation, facilitation and negotiation services. My two objectives in every matter are to reach a timely, efficient and ethical solution to the parties' dispute and enhance the attorneys' capabilities of resolving problems.

 

To that end I apply years of mediation, facilitation and negotiation experience and education. I can never guarantee a negotiated solution will be reached in a dispute but I can assure every client a relentless, knowledgeable and educated effort and that all avenues of a possible negotiated solution will be explored.

 

I use an evaluative and interest based style of mediation with everyone in the mediation working collaboratively to solve the parties' dispute.

 

In appropriate cases, I suggest the parties develop a tailored-made mediation process to help reach a settlement.  A one-size-fits-all mediation process often undermines the chances for a mediated settlement.  In the commercial law field some have called this the "Guided Choices" process.  I call it "Comprehensive Mediated Resolutions."  It can be very effective in the environmental and land use field, commercial law and most complex litigation or dispute situations.

 

It is an innovative process that creates a unique, case-directed mediation process to resolve the parties' dispute taking into consideration the circumstances, facts and law of the case. This area is relatively new but offers real financial and other benefits to clients.  Please contact me if you are interested in getting more information about this.

 

In addition, I provide facilitation and negotiation services for clients.  I have also been retained to perform a number of Special Magistrate proceedings pursuant to the Florida Land Use and Environmental Dispute Resolution Act, Section 70.51 Florida Statutes.

 

I have also performed many mediations for Florida governmental authorities pursuant to Chapter 164, Florida Statutes.

 

I have taught about mediation and related topics at Florida Bar CLE programs and in law schools.

I have been involved in large complex mediations taking a number of years to succesfully complete as well as projects that a mediated solution was reached within hours.

 

My areas of practice are environmental and land use, commercial, government and administrative, and real property law.
